SECTION 1 - INTRODUCTION AND DEFINITIONS

1. Introduction. The GPM Terms and Regulations:
(a.) is a document which states the rules governing the use and operation of GTAPoliceMods.com and automatically applies to any GTAPoliceMods infrastructure user;
(b.) are subject to amendment at any time without prior nor subsequent notice;
(c.) will be organized in the following manner: section, sub-section, and paragraph, followed by sub-paragraph if need be.
(c.i) An example of referencing the GPM-TR: s. 1(1)(c.i) (section 1, sub-section 1, paragraph c, sub-paragraph i).
(d.) cannot be superseded except in those specific circumstances where this is expressly permitted by the GPM-TR.

2. Liabilities. GPM and its staff:
(a.) do not endorse any of the content hosted or depicted on GPM space and will not be held liable for any issues, problems or complications that may result from using content procured therefrom;
(b.) cannot be held liable for any misuse of or damage caused by content taken from GPM space, as submitted content, once downloaded, becomes the responsibility of the end-user;
(c.) are not liable for anything transmitted or received on GPM space and will assist law enforcement (should the need arise) with any relevant information it may have available.

3. Definitions. In the following document:
(a.) "GPM" is used to refer to the entity that is GTAPoliceMods; 
(b.) "GPM-TR" is used to refer to the GTAPoliceMods Official Terms and Regulations;
(c.) "GPM space" is used to refer to any infrastructure or organization owned or governed by GPM;
(d.) "DD" is used to refer to the office of deputy director;
(e.) "ADD" is used to refer to assistant deputy director;
(f.) "SD" is used to refer to section director;
(g.) "SM" is used to refer to senior member;
(h.) "BOD" is used to refer to the GPM Board of Directors;
(i.) "BOR" is used to refer to the GPM Board of Representatives;
(j.) "GPM-C" or "Congress" is used to refer to the GPM Congress as a whole.
(k.) "GPM-PSC" or "PSC" is used to refer to the GPM Public Service Commission.



SECTION 2 - ADMINISTRATION

1. Organization.
(a.) The administration of GPM will be conducted in a hierarchical fashion in accordance with the principles of span of control and unity of command.
(b.) All GPM staff will be categorized into vertical classification levels in order to ensure a straightforward and easily identifiable hierarchy. The number of these is subject to change at any time as they can be modified by the director or DD.
(c.) GPM's core operations will be divided into departments responsible for accomplishing and providing specific tasks and services.

2. Administration.
(a.) Ultimate authority resides within the office of the director of GPM who is seconded by the deputy director (DD).
(b.) The director and DD may be assisted by a maximum of two assistant deputy directors (ADD).
(c.) Together, the director, DD and ADD form the GPM administration.

3. Sub-administration.
(a.) Section directors (SD) may be appointed or dismissed by the director or DD (or by the ADD with the express consent of the director or DD) in order to manage a GPM staff department.
(b.) SD may recommend staff to be hired for their respective departments and may appoint them with the consent of the director or DD.
(c.) SD are responsible for all aspects of the administration of their respective assignments and are answerable to a designated member of the administration.
(d.) SD solely form the sub-administration (department directorate), which is subordinate only to the administration.

4. Appointments, transfers, and dismissals.
(a.) In accordance with the GPM Public Service Act:
(a.i) the director and DD may appoint and dismiss staff at will without requiring consent as well as create, modify, and eliminate new staff positions;
(a.ii) any staff may be promoted only by the director or DD (or by the ADD with the express consent of the director or DD) and may be transferred to any position of equal rank by a member of the administration;
(a.iii) non administrative staff may be dismissed at any time by the director or DD (or by the ADD with the express consent of the director or DD).

5. Executive orders and directives.
(a.) Executive orders (EO) are official directives which can be issued only by the director or DD and may supersede the GPM-TR. Executive orders:
(a.i) must be documented and made available to all concerned GPM staff members and to this effect must be named in a standardized fashion and archived upon both issuance and completion;
(a.ii) may remain valid for a duration of one month (or 31 days) following issuance and upon expiration may be reauthorized for another period of one month or 31 days by the director or DD;
(a.iii) may be deauthorized at any time by the director or DD.
(b.) Directives may be issued by any member of the administration or sub-administration to subordinate staff. Those ordered to accomplish a directive must submit timely reports in order to detail the means used and the success or failure of the order. Directives must be named in a standardized fashion and archived upon issuance and completion.



SECTION 3 - GPM CONGRESS

1. The GPM Congress is bicameral in nature:
(a.) the upper chamber being the Board of Directors (BOD) and,
(b.) the lower chamber being the Board of Representatives (BOR).
(c.) Automatic membership to the BOD is granted to all members of the administration and sub-administration while automatic membership to the BOR is granted to all staff members (excluding administration and sub-administration positions) and all those designated as GPM senior members.

2. Members of either chamber may propose:
(a.) New legislation, modifications to existing legislation, or the abolition of existing GPM-TR, new candidates for staff positions, as well as anything else relating to GPM operations. Members of either chamber may also propose: the removal, impeachment, or reprimanding of any acting GPM staff members, members, and senior members.
(a.i) In the event of an impeachment motion, the successful removal of a GPM administrator requires the consent of 3/4 of the votes cast in both chambers. The director is exempt from any impeachment or reprimand.
(a.ii) In order for any change requiring the Congress to take place, it must first win support of the majority (>50 of the votes cast in both chambers where voting will be conducted via forum polls which must remain open for a minimum of 24h (though their time length may be set prior to their taking place).
(a.iii) The director and DD reserve the right to veto any legislation passed by any chamber though a veto can be overridden by a 3/4 majority of votes cast in both chambers. (a.iv) Executive orders and directives may be overridden by a 2/3 majority of votes cast in both chambers.



SECTION 4 - VIOLATIONS

1. Failure to comply with the GPM-TR can result in: termination of the violator's GPM forum account or banning of the violator's IP range from the GPM site and services.
(a.) For reasons or security, all bans issued by GPM personnel are permanent and thus cannot be reversed unless otherwise authorized by the director or DD.
(b.) All GPM staff reserve the authority to take any action necessary in order to maintain order on the GPM website so long as these do not contravene the GPM-TR.
(c.) The creation of a security database is prescribed within which every severe violation and banishment must be adequately documented by GPM staff assigned to this effect.

2. Minor offenses are infractions to the GPM-TR deemed mild in nature.
(a.) They include: spamming (posting the same or similar message in excess of 2 consecutive times or posting in the same topic in excess of 2 consecutive times; omitting to provide proper credits; use of racist or derogatory language; articulation and/or advancement of racist or inflammatory ideas; instigation of (or negative participation in) a conflict; demeaning, teasing, or insulting of any GPM member (or demeaning, teasing, or insulting of any GPM member based on ethnicity, race, gender, or sexual orientation); possession of more than one website account; attempting to unknowingly pass off stolen work as one's own.
(b.) Consequences for commission of a minor offense lay at GPM staff's discretion and may include: temporary account suspension, post/topic deletion, written warnings, warning level increases (for which a user may receive up to 5 warnings before requiring a minimum 72h ban.), download access suspension, and a reset of the user's post count. Any corrective or punitive measure imposed as a result of a minor violation may be reviewed by staff after one month of its issuance.

3. Major offenses are violations of the GPM-TR which jeopardize the integrity or security of GPM or any GPM user.
(a.) They include: posting or dissemination of nudity or any type of pornographic material; posting or discussion of contraband, illegal, or pirated software or links to such items; impersonation of any GPM member or real-life public official; active use of more than one website account; subversion; sharing of sensitive or confidential GPM information with outside sources; attempting to knowingly pass off stolen work as one's own; posting or linking to any malicious software or code; attempts to hack, abuse, or harm GPM or GPM's servers; excessive repetition of minor offenses.
(b.) Consequences for commission of a major offense lay at GPM staff's discretion and may include: (any minor offense consequence as well as) permanent banishment, temporary banishment, reporting of the violator's offense and information to law enforcement.

4. Mixed offenses are violations of the GPM-TR which, contingent upon the circumstances, may be categorized as either minor or major.
(a.) They include: any excessively repeated minor violation (which may then qualify as major) or any genuinely unintended major violations (which may then be construed as minor), as well as violations of executive orders and directives.
(b.) Consequences for commission of a mixed offense lay at GPM staff's discretion and may include any corrective measure required by the GPM-TR based on the interpretation of the mixed offense as either minor or major.



SECTION 5 - GPM MEMBERSHIP AND MEMBERSHIP TYPES

1. General.
(a.) A GPM member is any individual who is registered on any GPM space (excluding game servers).
(b.) GPM staff and special groups are also considered GPM members.
(c.) GPM members may be categorized into advanced non-staff groups in which case these members will be designated as "senior members". Thus, the term "senior member" (SM) encompasses all GPM membership types which have been officially granted non-staff privileged positions.
(c.i) In order for a SM to be moved from his forum group or banished, consent of the GPM director or DD is required. 
(c.ii) A SM may only be banned without the consent of the director or DD if the individual poses an immediate and severe risk to the security of GPM, in which case the director must be immediately notified.

2. Membership rights.
(a.) A GPM member may not be ostracized or punished simply for being affiliated to any group or organization unless it is determined that this affiliation may jeopardize the security or integrity of GPM or lead to a violation of the GPM-TR.



SECTION 6 - GPM ACCOUNTS AND WEBSITE USE

1. All GPM regulations pertaining to the GPM website use apply to every facet of the GPM website and GPM instant messaging systems. These regulations are the following:
(a.) A GPM website account is the responsibility of its owner. Any misconduct resulting from misuse of a particular account (by any claimed individual) therefore is attributable to the account owner.
(b.) English will be recognized as the official language of GPM.
(b.i) Public use of any other language is forbidden outside of areas where this is expressly permitted unless otherwise authorized by appropriate GPM staff.
(c.) Topics must be posted in appropriate sections and must bear appropriate titles (given their content).
(d.) The posting of requests outside areas designated to this effect (unless otherwise expressly stated by appropriate GPM staff) is prohibited.
(e.) Reviving a dormant topic by posting "bump" or any similar benign message is not permitted.
(f.) Posting of rules from other websites is not permitted unless they are posted in an area designated to this effect with the authorization of GPM staff.
(g.) Advertisement of (or any publicly displayed audio or visual references or links to) groups and organizations is forbidden outside of areas where this is expressly permitted unless otherwise authorized by appropriate GPM staff.
(h.) All videos posted on the GPM website must be hosted on YouTube and can be linked through the GPM site unless otherwise authorized by GPM staff.
(h.i) Linking to sites such as YuKu is not permitted.



SECTION 7 - MODIFICATIONS

1. Regarding emblems and logos:
(a.) All vehicle replicas of real-life counterparts are considered designed by the original real-life company (such as Ford, Chevrolet, etc.) thus modders may not have express copyrights over any replica vehicle's design, and therefore cannot claim to have it. Furthermore, all seals, emblems, and logos placed on a modification are copyright of their respected real-life owners.
(b.) Custom and fictitious seals, emblems, or logos, once released on the GPM site are considered open-source.

2. Regarding author rights: 
(a.) Proper credits must be visibly provided for every aspect (including models, parts, textures, sounds, etc.) of a released modification. However, credits do not necessarily need to be provided if the modification is a creation of the individual drafting said credits. If the original author of a modification is unknown, then this must be specified upon release of the modification. Users receiving authorization from the original author to edit a modification otherwise deemed forbidden to edit must clearly state that permission was given for their actions and must specify by whom said permission was given.
(b.) Permission from the original author of a modification is not required for the modification's release or edit as long as all proper credits are given. Any modification released on the GPM site can be used and altered by other users unless these actions are forbidden (either verbally or otherwise) by the original author.
(c.) Nonverbal forms of forbiddance of the unauthorized editing of a modification include the display of copyright logos (on textures) and model locking.
(d.) Any modification released on the GPM site cannot be released elsewhere without the explicit consent of the modification's author.
(e.) Disputes regarding modifications, their authors, and credits are to be managed by GPM personnel assigned to this effect.

3. Regarding modification releases:
(a.) Released modifications may only be posted on the GPM website or linked to hosting sites such as 4Shared, Megaupload, or UploadFFS and must be packaged in a .RAR or .ZIP file containing a relevant "readme" and all files required for a proper installation.
(a.i) Links to sites such as Freewebs and portals for the dissemination of modifications is not permitted.
(a.ii) Locked or password-protected modification release archives (and links to them) are prohibited and subject to deletion from the GPM site. Furthermore, all mods released on the GPM site must be free of charge and cannot be released with special conditions.
(a.iii) Pictures, a description, credits, and installation instructions must be provided with every publicly released modification as well as alongside work-in-progress (WIP) modifications.
(b.) Release of any modification or file designed to be harmful or which contains harmful files or applications is strongly prohibited and considered a severe offense.
(c.) Once it is submitted to the website, a file or modification may not be removed without the consent of appropriate GPM staff despite the intentions of the author or poster. Those submitting files and modifications to GPM space, though they are entitled to fair credit, forfeit to GPM control over the hosting and distribution of the material they submit (to GPM space).



SECTION 8 - GPM PUBLIC SERVICE ACT

1. GPM Public Service Commission.
(a.) The mandate of the GPM Public Service Commission (Commission, GPM-PSC, PSC) is to recruit and promote on the basis of merit, to ensure fairness, equity and transparency in staffing, and to provide impartial recourse and review.
(b.) The GPM-PSC will be composed of the members of the administration, as well as those of the directorate (sub-administration).

2. Appointment process.
(a.) A GPM member may be proposed to the Commission as a candidate for a specific staff position at which time the candidate must be evaluated by the GPM-PSC.
(b.) The requirements for the proper execution of the functions related to the position for which the candidate has been proposed (these may include any the Commission deems relevant) shall be reviewed alongside the applicant's qualifications.
(c.) The head of the security service shall be tasked with investigating the candidate's history as well as assessing his behaviors and potential behaviors.
(d.) If the candidate meets the requirements and is found not to pose any security risk to GPM, the members of the Commission will vote to appoint or reject the candidate.
(d.i) A favorable majority of votes is required in order for a candidate to win appointment.
(d.ii) The director and DD reserve the right to veto any decision made by the Commission.

2. Appointments.
(a.) Appointments by the Commission shall be made on the basis of merit and must be free from patronage and political influence.
(b.) An appointment is made on the basis of merit when the Commission is satisfied that the person to be appointed meets the essential qualifications for the work to be performed, as established by the department head or administration and the Commission has regard to:
(b.i) any additional qualifications that the department head or administration may consider to be an asset for the work to be performed, or for the organization, currently or in the future;
(b.ii) any current or future operational requirements of the organization that may be identified by the department head or administration;
(b.iii) any current or future needs of the organization that may be identified by the department head or administration.

3. Resignations.
(a.) A staff member may resign from the GPM public service by giving the department head, department supervisor, or administration notice in writing of his intention to resign, and the staff member ceases to be a staff member on the date specified by the department head in writing on accepting the resignation, regardless of the date of the acceptance.

4. Complaints and investigations.
(a.) The Commission may investigate any appointment and, if it is satisfied that the appointment was not made or proposed to be made on the basis of merit, or that there was an error, an omission or improper conduct that affected the selection of the person appointed or proposed for appointment, the Commission may:
(a.i) revoke the appointment or not make the appointment;
(a.ii) take any corrective action that it considers appropriate.
(b.) A person whose appointment is revoked by the Commission or by the department head may, make a complaint to the Commission that the revocation was unreasonable.
(b.i) In such a case, the person appointed or proposed for appointment and the department head are entitled to be heard by the Commission.
(b.ii) Every decision of the Commission is final and may not be questioned or reviewed.
(c.) Where a staff member is discharged, the Commission may appoint that person to another position if the Commission is satisfied that the person meets the essential qualifications to exercise the duties of the office in question.

5. Discharge.
(a.) A staff member may be formally discharged by his department head, supervisory administrator, the director or DD in accordance with the regulations of section 8, sub-section 5 of the GPM-TR.
(b.) A staff member may be discharged of his duties only if the staff member:
(b.i) poses a security risk to GPM;
(b.ii) has violated the GPM-TR;
(b.iii) has demonstrated incompetence with regard to the execution of his duties;
(b.iv) has demonstrated dereliction of his assigned duties;
(b.v) has acted in a manner deemed inappropriate for a GPM public servant;
(b.vi) has as a direct result of his actions jeopardized the integrity of GPM.
(c.) Where the services of a staff member are no longer required by reason of lack of work or the discontinuance of a function, the department head may, in accordance with the regulations of the Commission, discharge the staff member, in which case the department head shall so advise the staff member.
